  • What happens if I die without a Will?
    • If you die without a Will, the state, by intestacy laws, will determine who inherits your estate.
  • What are the advantages of a Living Will?
    • The advantages of executing a Living Will are that you are able to make the decision about receiving life support. A Living Will can also alleviate family anxiety and arguments.
  • To whom should I give Power of Attorney (POA)?
    • Any person that you trust to handle your financial matters and medical decisions.
  • What is a Durable Power of Attorney?
    • A general Durable Power of Attorney names an agent or attorney-in-fact to handle your affairs if you become mentally or physically disabled.
  • Are there differences between medical and financial POAs?
    • Yes. A Medical Power of Attorney is for your healthcare decisions and a financial Power of Attorney is for your finances.
  • What happens if someone challenges my Will?
    • A hearing in Probate Court may be necessary to determine the validity of your will.
  • Do I have to find my old will before I can make a new one?
    • While it is always best if your old will can be found, it is not necessary to find it in order to create a new Will. If you find your old will, it should be destroyed.
